Additional Areas Subject to Mitigation Plan Requirements Under the Exceptional Events Rule
In April 2022, EPA notified air agencies in California, Nevada, New Mexico, and Wyoming that under the 2016 Exceptional Events Rule they will need to develop plans – known as mitigation plans - for certain areas within their states. These areas are experiencing recurring events that impact air quality and public health. EPA is also issuing a Notice of Availability (NOA) making the public aware of this notification. The states will have two years to complete and submit these plans to EPA.
EPA ensures these plans are complete and that the submitting air agency followed the public comment process. If EPA deems the mitigation plans to be complete, air agencies, can submit and EPA can approve future demonstrations for the area for the same event type and National Ambient Air Quality Standard combination.
