PENNSYLVANIA LABORATORY DIRECTOR AND COMPANY SENTENCED FOR MAIL FRAUD
On Oct. 27, Michael L. Klusaritz, former Laboratory Director at Hess Environmental Laboratories in East Stroudsburg, Pa. and former operator of the now closed Phase II Laboratories in Catasauqua, Pa., was sentenced in U.S. District Court for the Eastern District of Pennsylvania in Philadelphia for making false statements and mail fraud. Klusaritz also previously entered a guilty plea on behalf of Phase II laboratories. Klusaritz and Phase II admitted to defrauding customers who were billed more than $214,000 for environmental lab tests that were never performed. Klusaritz received a sentence of one year in prison followed by three years supervised release. In addition, Klusaritz and Phase II must pay a total of $40,000 in restitution. The case was investigated by EPA’s Criminal Investigation Division, EPA’s Office of Inspector General, and the Criminal Investigation Division of the U.S. Army, with the assistance of EPA’s National Enforcement Investigations Center.
