ESSROC Cement Agrees to Pay $7,500 Over Air Issues

PHILADELPHIA – The U.S. Environmental Protection Agency today announced that ESSROC Cement Corp. has settled an alleged Clean Air Act violation at its cement plant in Frederick, Md. In a consent agreement with EPA, ESSROC has agreed to pay a $7,500 penalty and improve the air pollution monitoring at the plant, which is located at 4129 Buckeystown Pike.
EPA cited the company for inadequate monitoring of pollution from the plant’s kiln stack. According to EPA, air pollution monitoring on December 15, 17 and 18, 1998 for sulfur dioxide and particulate matter emissions violated federal and Maryland requirements because it was not conducted under normal or representative conditions.
In addition to the penalty, ESSROC agreed to install and certify continuous emission monitors (“CEMs”) for sulfur dioxide and carbon monoxide, certify its existing CEM for nitrogen oxide emissions, and submit annual monitoring reports to EPA and the Maryland Department of the Environment (MDE) based on the results of the monitors.
As part of the settlement, ESSROC neither admitted nor denied liability for the alleged violations. MDE assisted EPA’s investigation of this matter.
