SOUTH DAKOTA COMPANY GUILTY OF CLEAN WATER ACT VIOLATIONS

On Jan. 21, four defendants pleaded guilty in Federal Court in the District of South Dakota in Sioux Falls, for their roles in the unlawful discharges of metal finishing industrial wastewater in violation of the Clean Water Act. Kenneth Pap, president of Dakota Plating; Anthony Sferrazza, plant manager; Tim Schwaller, wastewater operator, pleaded guilty to one count of negligently discharging wastewater from the facility into the Sioux Falls sanitary sewer system which is part of the city’s publicly owned treatment works. Also, Jeff McCrea, former plant manager, pleaded guilty to one count of conspiring to negligently discharge wastewater. At the same time, Dakota Plating company pleaded guilty to a felony charge of knowingly discharging industrial wastewater. Sentencing for these four defendants, and the corporation is scheduled for April 6. This investigation was conducted by EPA’s Criminal Investigation Division.
