Three Executives at West Virginia Metal Finishing Company Sent to Prison for Violating the Clean Water Act

CHARLESTON, W.Va. -- Donald Hoffman, 63, and his two sons pleaded guilty in federal court and were sentenced Tuesday for discharging contaminated wastewater directly into a public sewer system.

The details of the charge and conviction are spelled out in the attached press release from the U.S. Attorney’s Office in Charleston.

Hoffman, of Prosperity, W.Va., was sentenced to a year in prison and one year of probation. Curtis Hoffman, 29, received a 15-month prison term plus one year of probation. Rodney Hoffman, 32, was sentenced to 11 months in prison and one year of probation.

Their company, Hoffman Metal Finishing, Inc., was fined $15,000, put on probation for five years and ordered to publish its conviction in a trade publication.

The case was investigated by the U.S. Environmental Protection Agency’s Criminal Investigation Division; the West Virginia Division of Environmental Protection, FBI; and West Virginia State Police.
