WEST VIRGINIA MAN PLEADS GUILTY
TO ILLEGAL SEWAGE DISCHARGE
TO ILLEGAL SEWAGE DISCHARGE
James Bragg of Lanark, W.Va., pleaded guilty on July 27, in U.S. District Court in Charleston to violating the Clean Water Act. Bragg owned a sewage treatment facility in Grandview, W.Va., which serviced the Oaks subdivision. The defendant admitted that in June 1996, he allowed untreated sewage to be discharged into Pledge Branch which is a tributary of the New River. Untreated sewage waste can contain fecal coliform and other bacteria and pathogens which can cause people who are exposed to develop a variety of infectious diseases. Bragg faces a maximum sentence up to three years in prison and/or a fine of up to $250,000 when sentenced. The case was investigated by EPA’s Criminal Investigation Division and is being prosecuted by the U.S. Department of Justice.
