COMPLAINT AGAINST DUPONT FOR NOT ALERTING EPA
OF POSSIBLE ADVERSE EFFECTS OF A PESTICIDE

On Sept. 30, EPA filed a complaint against E. I. DuPont de Nemours and Co. Inc. (Dupont) of Wilmington, Del., for the company’s failure to report timely information about possible human adverse effects from its pesticide Benlate Fungicide, EPA Reg. No. 352-354, in violation of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). This law gives EPA the authority and responsibility for registering pesticides for specified uses, provided that such uses do not pose an unreasonable risk to human health or to the environment. Pesticide registrants are required to report adverse effects of a pesticide for use in Agency decisions about its appropriate uses, labeling and continued registration. If pesticide registrants have information about unreasonable adverse effects of a registered pesticide, they are required to submit such information to EPA. The Agency is seeking a civil penalty of $16,500. Registrants have 30 days to respond to EPA’s complaints and may request a hearing to contest the facts in the complaint or the size of the penalty.
