Competition Reopens for 2004 Brownfields Loans and Cleanup Grants

EPA is reopening the Brownfields grant competition for the current fiscal year (2004), because recent changes to the law may allow some groups and communities to be eligible for funding who previously had not been. This change results from the Consolidated Appropriations Act of 2004, signed into law by President Bush on Jan. 23, which temporarily expands the number of Brownfield sites eligible for funding by EPA under the auspices of a "Brownfields Assessment, Revolving Loan Fund, and Cleanup Grant."
This year's grant competition has been reopened to ensure that all eligible entities have the opportunity to submit (or resubmit) proposals for Brownfields funding. To qualify for participation in the reopened competition, applicants must have specific Brownfields sites identified, and the sites must be eligible for funding based on provisions of the Consolidated Appropriations Act of 2004.
Applicants who submitted proposals by the previous Dec. 4, 2003 deadline, and who otherwise satisfied all eligibility requirements, including all elements required to qualify as a bona fide prospective purchaser (as defined in federal law under CERCLA sec.101(40)), but who were determined by EPA to be prohibited from using Brownfield funds at the proposed site(s) because the applicant acquired the Brownfield site prior to the Jan. 11, 2002 enactment date of the Small Business Liability Relief and Brownfields Revitalization Act of 2001, may choose to resubmit their proposal for consideration.
An original proposal and/or a request for reconsideration of a proposal that was submitted by Dec. 4, 2003, must be received no later than 6:00 p.m. EST, March 9. Applicants must also provide a copy to the EPA Regional Brownfields Coordinator at the addresses shown in Appendix 1 of the Oct. 2003 Proposal Guidelines.
