EPA CITES CLEAN WATER ACT VIOLATIONS AT JIM THORPE CONSTRUCTION SITE

JIM THORPE, Pa. -- The U.S. Environmental Protection Agency today announced that it has cited Gregory Strubinger and Gerald Strubinger, both of Jim Thorpe, Pa., for unlawfully dumping fill material into a waterway.

The Clean Water Act complaint alleges that the Strubingers discharged fill material into approximately 200 feet of a tributary of Robertson Run during the construction of a home at 8th Street in Jim Thorpe. EPA proposes a $27,500 penalty for this alleged violation.

Under the Clean Water Act, a U.S. Army Corps of Engineers permit is required before dredged or fill material may be discharged into waterways or wetlands. EPA issued the complaint after the Strubingers failed to respond to cease and desist orders from the Army Corps of Engineers and the Pennsylvania Department of Environmental Protection.

These individuals have the right to a hearing to contest the alleged violations and proposed penalty.
