Consolidated Rail Corporation Cited for Not Reporting Chemical Storage

HOLLIDAYSBURG, Pa. - The U.S. Environmental Protection Agency has cited Consolidated Rail Corporation (CRC) for failing to report the storage of diesel fuel and sulfuric acid at its Hollidaysburg, Pa. repair shop.

In a March 9, 1999 administrative complaint, EPA proposed a $31,875 penalty for violations of the  Emergency Planning and Community Right-to-Know Act (EPCRA) at CRC’s facility on Loop Road.  The violations were uncovered during a February 11, 1998 inspection.

EPCRA was enacted to protect public health and the environment from accidental releases of hazardous and toxic chemicals.  The law requires companies that store over a threshold quantity of hazardous chemicals to file "material safety data sheets" (MSDS)  -- or a list of chemicals requiring MSDSs -- with the state and local emergency response agency and the local fire department.  The MSDS describes the health risks  associated with the chemical, and safety precautions for handling or accidental exposure.

EPCRA also requires companies to annually update state and local emergency response agencies, and the local fire department, on the maximum and average amount of hazardous chemicals present at the facility.  

According to EPA’s complaint, CRC failed to submit the MSDS (or list), and annual inventory forms for diesel fuel and sulfuric acid stored at the facility.  Note: The complaint addresses reporting violations, not actual spills or leaks of the chemicals.

The company may request a hearing to contest the alleged violations and proposed penalties.
