ILLEGAL STORAGE OF HAZARDOUS WASTES LEADS TO FELONY GUILTY PLEA FOR UTAH PLANT MANAGER
On July 11, Bruce Jones, plant manager of Reclaim Barrel Supply Inc. and Allstate Container Inc. of West Jordan, Utah, pleaded guilty to one felony count of violating the Resource Conservation and Recovery Act (RCRA), for the illegal storage of hazardous wastes. Both of these facilities were in the business of recycling barrels. Jones and codefendant Ray McCune, owner of Reclaim Barrel and Allstate Container, illegally stored 311 drums and a total of 23,500 gallons of hazardous waste at the two sites in violation of RCRA. In addition, an estimated 5500 gallons of hazardous waste and other pollutants were discharged from Allstate Container into a publicly-owned sewage treatment facility in violation of Allstate Container's Clean Water Act pre-treatment permit. Both facilities were abandoned by Jones and McCune and a time-critical removal action was conducted by EPA Region 8 to clean up the abandoned wastes. The case was investigated by EPA's Criminal Investigation Division.
