OFFICIALS OF DEFUNCT OREGON PAINTING COMPANY INDICTED FOR VIOLATING RCRA
Darlene Warner and Duane Warner, former principals in C&I Coatings of Portland, Ore., were indicted on June 19, in U.S. District Court for the District of Oregon in Portland for violating the Resource Conservation and Recovery Act. The indictment charged Darlene Warner with conspiracy and with illegally transporting, storing and disposing of hazardous waste. Duane Warner was charged with aiding and abetting in the disposal of commercial refuse on public lands. C&I coatings ceased doing business in 1994 and drums of flammable liquids from C&I, including paint sludge, paint waste, solvents and lacquer thinner, were illegally disposed of on Bureau of Land Management property about 10 miles southwest of Crow, Ore. If convicted, Darlene Warner faces a maximum sentence of up to 10 years in prison and/or fines of up to $60,000. Duane Warner faces a maximum of up to one year in prison and/or fines of up to $100,000, if convicted. The case was investigated by EPA’s Criminal Investigation Division and the Bureau of Land Management.
