INDIANA COMPANY CHARGED WITH CLEAN WATER ACT VIOLATIONS
Industrial Coating Services (ICS) of Indianapolis, Ind., agreed to enter a plea agreement on June 1, in U.S. District Court for the Southern District of Indiana in Indianapolis to violating the Clean Water Act. The company is charged with discharging industrial waste, including paint, into a tributary of Bean Creek in December 1995 without having a National Pollutant Discharge Elimination System permit. The defendant is also alleged to have discharged paint waste into the Indianapolis municipal sewer system. As part of the court action, a plea agreement was filed in which ICS agreed to pay a $50,000 fine, serve two years probation and pay an additional $50,000 in penalties if the terms of the probation are not met. If ICS is convicted, the actual sentence will be determined by the court, pursuant to Federal Sentencing Guidelines. The case was investigated by EPA’s Criminal Investigation Division, the FBI and the Indianapolis Department of Public Works and Environmental Resources.
