CLINTON ADMINISTRATION RELEASES LEGISLATIVE PRINCIPLES
FOR RCRA REFORM
The Clinton Administration recently released its Remediation Waste Legislative Specifications. These specifications outline an approach to fostering or accelerating protective cleanups by providing targeted changes to the Resource Conservation and Recovery Act land disposal restrictions, minimum technology and permitting requirements that currently apply to hazardous remediation wastes and some environmental media generated during cleanups. The specifications call for an approach that would give EPA authority, through rulemaking, to define remediation waste, establish tailored remediation waste management, treatment and disposal requirements and establish a new form of RCRA permit for remediation waste management facilities. To provide appropriate reform quickly, the specifications also outline a set of interim remediation waste treatment, management and disposal requirements that would apply until EPA promulgates new regulations. The legislative specifications were informed by stakeholder discussions sponsored last Summer by the EPA and the Council for Environmental Quality and by the Recent GAO report, “Remediation Waste Requirements Can Increase the Time and Cost of Cleanups.” The report will be available on the Internet at: www.epa.gov/correctiveaction under What’s New.
