WEST VIRGINIA CONTRACTOR SENTENCED FOR CLEAN AIR ACT VIOLATIONS
On Oct. 3, David Marshall, a former asbestos removal and demolition contractor from Harrison County, W.Va., was sentenced in U.S. District Court for the Northern District of West Virginia to 15 months in prison, three years supervised release and ordered never to perform demolition or conduct asbestos abatement work again. Marshall was convicted of violating the Clean Air Act and making false statements. Marshall removed asbestos from an apartment building in Clarksburg, W.Va. in June 1995, despite the fact that his license to conduct asbestos removal was revoked in 1994. Marshall failed to notify EPA or the state of West Virginia prior to the removal, failed to adequately wet the asbestos during and after the removal, failed to have a properly trained person on site during the removal and falsely told a state employee that the removal had not begun. Exposure to asbestos fibers can lead to lung cancer and a lung disease known as “asbestosis.” The case was investigated by EPA’s Criminal Investigation Division, the West Virginia Department of Health and Human Services and the West Virginia Department of Environmental Protection with the assistance of EPA’s National Enforcement Investigations Center.
