TENNESSEE MAN ADMITS ILLEGALLY STORING HAZARDOUS WASTES

On April 23, Joe Proctor of Chattanooga, Tenn. pleaded guilty to violating the Resource Conservation and Recovery Act. Proctor formerly owned R&D Products in Chattanooga which produced and distributed industrial cleaning solvents. The company went out of business in 1997, and the defendant knowingly stored hazardous wastes at the closed facility without a permit until 1999. The wastes included ignitable hazardous wastes. When sentenced, Proctor faces a maximum sentence of up to five years in prison and/or a fine of up to $250,000. The case was investigated by EPA’s Criminal Investigation Division and members of the East Tennessee Environmental Crimes Task Force. It is being prosecuted by the U.S. Attorney’s Office in Greenville, Tenn.
