Wetlands Penalty Sought in Idaho Lodge Construction

In an administrative complaint filed today, the U.S. Environmental Protection Agency(EPA)alleges that David Eby, owner of Island Park’s Angler’s Inn, violated the terms of an Army Corps of Engineers(Corps)permit to construct a lodge along the Henry’s Fork of the Snake River. The EPA is proposing a $40,000 civil penalty.
According to Chuck Clarke, EPA regional administrator in Seattle, wetland violations by permit holders are especially troubling.
"After obtaining a permit, he should have known better," said Clarke. "The plans he submitted to the Corps were very explicit, detailing where and how he could proceed with his project. Mr. Eby went way beyond those plans."
EPA's complaint alleges that Eby filled an area five times larger than he was permitted, in part to add a parking lot. The complaint also charges that Eby failed to construct the project in accordance with the plans and drawings enclosed with his permit application and ignored critical terms and conditions of the permit.
Should Eby desire a hearing on the proposed penalty, he must submit a formal request, in writing, within 30 days of receipt of this complaint.
