EPA PUBLISHES NEW LIST OF EXTREMELY HAZARDOUS SUBSTANCES

EPA is taking final action on two proposed rules that fulfill one of the Agency's regulatory reform commitments set forth in its June 1, 1995, Report to the President. Through these actions, the Agency is reducing the burden of reporting for facilities presently required to report certain releases unnecessarily. Protection of human health and the environment is maintained while better focusing attention on releases that may require a response by state and/or local authorities. The final rule being issued modifies the extremely hazardous substances (EHS) list and reportable quantities under section 302 of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA), Title III of the Superfund Amendments and Reauthorization Act of 1986. EPA is raising the statutory reportable quantities(RQs)for 202 EHSs. EPA is also removing from the EHS list four chemicals that do not meet the listing criteria: phosphorus pentoxide, diethulcarbamaxine citrate, fenitrothion and tellurium. This rule will be effective 60 days from date of publication in the Federal Register. The notice is expected to be published within the next two weeks.
