Landmark Development LLC and EPA Agree on Vancouver-Area Wetlands Restoration

    Landmark Development LLC has entered into an agreement with the U.S. Environmental Protection Agency (EPA) to protect and create 2.5 acres of wetlands adjacent to Burnt Bridge Creek in northern Vancouver, Washington. This agreement will offset wetland impacts caused by the previous land developer J. Clifford Cook, Jr.’s violation of the Federal Clean Water Act (CWA) during the initial development of the site.

    This wetland mitigation will allow Landmark Development LLC to pursue the needed permits from the city, state and federal government to develop the remaining property as a planned residential development.

    In 1999, J. Clifford Cook Jr., through his company, Lacamas Creek Enterprises Inc., filled approximately 1.2 acres of wetlands adjacent to Burnt Bridge Creek without a U.S. Army Corps of Engineers (Corps) permit. The company was preparing to develop the site for residential use. Mr. Cook was aware of the existence of wetlands on this site and the need for a Corps permit before he conducted the work. EPA fined Mr. Cook for this violation but he was unable to restore the site because he no longer had access to the property and did not have adequate assets to perform the mitigation. Shortly after meeting with EPA regarding the restoration of the site, Mr. Cook filed personal and corporate bankruptcy actions and Lacamas Creek Enterprises Inc., began liquidating under Chapter 7 of the bankruptcy code.
