HAZARDOUS WASTE IDENTIFICATION RULE PROPOSED
EPA is proposing changes to its regulations under Subtitle C of the Resource Conservation and Recovery Act by revising the "mixture and derived from" rules. The mixture and derived from rules ensure that hazardous wastes that are mixed with other wastes or treated do not escape regulation as long as they are reasonably likely to continue to pose threats to human health and the environment. This proposal also includes a discussion of two regulatory options for self-implementing concentration-based exemptions: a generic exemption and a landfill-only exemption. In addition, this proposal also discusses the possibility of revising the land disposal restrictions by replacing technology-based treatment standards with risk-based treatment standards.
The proposed rule is expected to be published in the Federal Register in late November and will be available at: https://www.epa.gov/epaoswer/hazwaste/id/ or from the RCRA Hotline at 1-800-424-9346 or 703-412-9810.
