West Virginia Man Charged With Dumping Hazardous Waste In George Washington National Forest

PHILADELPHIA - The United States Environmental Protection Agency and the United States Attorney’s Office for the Western District of Virginia announced today that Donald T. Miller, of Wardensville, W.Va., was indicted by a federal Grand Jury November 8, in Charlottesville, Virginia.

Miller was charged in a three-count indictment with unlawful dumping in a national forest, disposing of hazardous waste without a permit, and transporting hazardous waste to a facility which did not have a permit. These charges arose out of an investigation concerning the discovery of drums of hazardous and other waste in the George Washington National Forest.

If convicted on all counts, the maximum penalty faced by the defendant is ten and a half years imprisonment and a fine of over $500,000.

The investigation of the case was conducted by the Environmental Protection Agency (EPA), the U.S. Forest Service, and the West Virginia Department of Natural Resources. Assistant United States Attorney Nancy Healey and EPA attorney Michael Fisher, will prosecute the case.

A Grand Jury indictment is only a charge and not evidence of guilt and the defendant is entitled to a fair trial with the burden on the government to prove guilt beyond a reasonable doubt.
