NEW EPA GUIDANCE ON THE TRANSFER OF
CONTAMINATED FEDERAL PROPERTY
CONTAMINATED FEDERAL PROPERTY
EPA has released new guidance, which establishes its process for determining whether contaminated federal property is suitable for transfer to non-federal parties prior to full completion of environmental cleanup. This guidance details the process for conveying contaminated federal property at National Priorities List sites to real estate developers, local redevelopment authorities, and state and local governments. By allowing earlier transfer of properties that do not pose unacceptable risks, communities can achieve the benefits of faster reuse and redevelopment. Such benefits can include the establishment of new businesses or recreational facilities, the creation of new jobs, and stronger local economies. The guidance, “EPA Guidance on the Transfer of Federal Property by Deed Before All Necessary Response Action Has Been Taken Pursuant to CERCLA Section 120(h)(3)” is available on the Internet at: https://www.epa.gov/swerffrr/doc/hkcover.htm.
