The U.S. Environmental Protection Agency (EPA) announced today the settlement of an administrative enforcement action against F. A. Sims Oil Company, Inc. of Lawrenceville, Georgia for alleged violations of the Underground Storage Tank (UST) provisions of the Resource Conservation and Recovery Act (RCRA).
The Administrative Complaint alleged a range of violations including failure to comply with tank and piping release detection requirements and failure to notify the implementing agency of the existence of all UST systems.
Under the terms of the Consent Agreement and Consent Order, the company has agreed to pay a civil penalty of $25,650 to the United States Treasury. In addition, the company has agreed to perform detailed tank management procedures and will provide leak detection monitoring reports to EPA for six (6) months following the settlement.
EPA developed the UST regulations to prevent leaks and spills, and should one occur, promptly abate, and correct problems caused by them. Leaking USTs can result in serious consequences; such as fires and explosions, contamination of drinking water and damage to lakes and streams.
