Army Settles Hazardous Waste Violations at Fort Eustis Transportation Facility

PHILADELPHIA (April 7, 2008) – The U.S. Army’s Transportation Center at Fort Eustis, located in Newport News, Va., has settled alleged violations of the federal Resource Conservation and Recovery Act (RCRA), the U.S. Environmental Protection Agency announced today.

RCRA regulations require that all hazardous waste containers be labeled or marked clearly with the words “hazardous waste” and that all containers holding hazardous waste be closed during storage. Also, RCRA regulations require that underground storage tanks be properly managed and that records of such activities be maintained.

During an EPA inspection April 24 – 27, 2006, one container of methanol and several containers holding waste solvent cleaner for paint spray guns, both hazardous wastes, were not clearly labeled. In addition, several containers holding waste solvent cleaner were open at the time of the inspection. Moreover, RCRA regulations pertaining to underground storage tanks require that records for leak detection must be maintained for one year. Although the facility was later able to provide EPA with some records, the full 12 months of leak detection records for several tanks at the facility were not available.

The U.S. Army has agreed to pay a civil penalty of $6,577 to settle the violations. In its settlement with EPA, the Army neither admitted nor denied liability for the alleged violations, but certified that it is now in compliance with applicable RCRA requirements at this facility.
