EPA SEEKS $69,400 IN CIVIL PENALTIES AGAINST REGISTRANTS
EPA has issued six civil administrative complaints against pesticide registrants seeking a total of $ 69,400 in penalties for violation of the Agency's Good Laboratory Practice Standards (GLPS) and the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). Under FIFRA, companies that intend to register pesticides must submit test data so that the Agency can study the potential risks posed by the pesticides to human health and the environment or that the product is as effective as claimed on the label. The GLPS were established to assure the quality and integrity of the data submitted by registrants. EPA conducts GLP inspections of laboratories that either submit pesticide studies to the Agency or conducts studies on behalf of pesticide registrants. The violations that EPA detected as a result of the inspections include failure to meet quality assurance requirements, incomplete final study reports and failure to verify raw data. A registrant who violates any provision of FIFRA may be assessed a civil penalty of not more than $5,500 for each offense. Other parties, such as testing facilities, must receive a written warning prior to being assessed a civil penalty. FIFRA also allows for the issuance of a Notice of Warning to sponsors/registrants of studies for minor violations. In addition to the civil administrative complaints, two of the six registrants also received Notices of Warning for studies which contained minor violations. EPA also issued Notices of Warning to one additional registrant and two contract/independent laboratories for GLPS violations. Registrants have 20 days to respond to the complaint and may request a hearing to contest the facts of the complaint or the size of the proposed civil penalty.
