CALIFORNIA MAN INDICTED FOR FALSIFYING
DISCHARGE REPORTS AT CAMP PENDLETON

Mark Stoffer of San Clemente, Calif., was arraigned on April 9 on seven counts of allegedly making false statements concerning discharge monitoring reports required for NPDES permits issued to the Camp Pendleton Marine Base under the Clean Water Act. Stoffer allegedly managed nine wastewater treatment plants at the base and supervised 25 plant operators. Seven of these plants had NPDES permits. The charges allege that the defendant directed the operators to falsely claim that tests in discharged wastewater of dissolved oxygen and residual chlorine were within permit limits. Falsifying test results can lead to discharging wastewater that is harmful to fish and aquatic life and can lead to contamination levels which make surface waters unfit for recreational purposes. The case was investigated by EPA’s Criminal Investigation Division, the Defense Criminal Investigation Service, the Naval Criminal Investigation Service and the FBI. It is being prosecuted by the U.S. Attorney’s Office in San Diego. Charged defendants are presumed innocent unless or until proven guilty in a court of law.
