SOUTH DAKOTA PLATING COMPANY AND OWNER INDICTED
Kenneth Pap of Sac City, Iowa, owner of Sun-Wise Systems Inc., and his company pleaded not guilty, on March 27, in federal court in Sioux Falls, S.D., to multiple felony charges. Pap and Sun-Wise operate a zinc plating facility in Sioux Falls under the name Dakota Plating. Pap and Sun-Wise are accused of the unpermitted discharge of wastewater in violation of the federal Clean Water Act, conspiracy and making false statements to the government. The charges allege that Pap and Sun-Wise falsely denied they were not dischargers after knowingly conspiring and discharging industrial wastewater from the Dakota Plating facility into the city of Sioux Falls wastewater treatment system without a permit from 1992 to 1996. The possible penalties range from 3-5 years imprisonment and/or fines of up to $500,000 on the various counts. The investigation was conducted by EPA's Criminal Investigation Division.
