TWO COMPANY EXECUTIVES SENTENCED FOR ENVIRONMENTAL CRIMES

On Nov. 5, Timothy J. Sinskey, senior vice-president and general manager of John Morell & Co., and his co-defendant Wayne R. Kumm were sentenced to prison for their conviction by a federal jury for violations of the federal Clean Water Act. Sinskey was convicted of 12 felony counts including modifying a monitoring method to obtain false readings, discharging hazardous substances, as well as falsification of Morrell's discharge monitoring reports. Sinskey was sentenced to 24 months in prison, which will be followed by two years of supervised release, a fine of $5000 and a payment of $600 to the federal victim witness fund. Kumm was convicted of one felony count of modifying a discharge monitoring method to give false readings. Kumm, was sentenced to 12 months, with six months in jail and six months in home confinement under electronic monitoring, fined $2000 and ordered to pay $8,000 restitution to the Big Sioux River Environmental Trust Fund. John Morrell & Co. was sentenced on May 28. This case was investigated by EPA's Criminal Investigation Division with support from EPA's National Enforcement Investigations Center.
