CALIFORNIA MAN INDICTED FOR FALSE REPORTS

On April 12, William J. Perley of Placerville, Ca., was indicted on April 12 on ten counts of violating the Clean Water Act. Perley, who acted as manager of the Crockett-Varona Waste Water Treatment Plant, allegedly caused the submission of false monthly wastewater discharge reports from the C&H Sugar Company to the California Regional Water Quality Control Board and to the U.S. EPA on ten occasions. The reports allegedly stated that chlorine was not found in the discharged wastewater when, in fact, tests indicated that the effluent contained reportable amounts of that chemical. In sufficient concentrations, chlorine is harmful to fish and other aquatic life. If convicted, the defendant faces a maximum sentence of up to five years in prison and/or a $250,000 fine on each count. The case was investigated by EPA’s Criminal Investigation Division and the FBI. It is being prosecuted by the U.S. Attorney’s Office in San Francisco. An indictment is merely an accusation and defendants are presumed innocent unless or until proven guilty in a court of law.
