PENNSYLVANIA MINING COMPANY CHARGED
WITH ILLEGAL DISCHARGE
WITH ILLEGAL DISCHARGE
Action Mining Inc., of Meyersdale, Pa., was charged on Sept. 21, in U.S. District Court in Pittsburgh with violating the Clean Water Act. The charge alleges that Action Mining discharged untreated acid mine drainage into Coal Run, a tributary of the Casselman River. Acid mine drainage is harmful to fish and other aquatic life, and in sufficient concentrations can cause burns and illnesses to people who use surface waters for drinking or recreational purposes. If convicted, the defendant faces a maximum fine of up to $500,000. The case was investigated by EPA’s Criminal Investigation Division with the assistance of the Pennsylvania Department of Environmental Protection and the EPA Region 3 Office of Water, and is being prosecuted by the U.S. Department of Justice.
