MONTANA MAN INDICTED FOR CLEAN WATER ACT VIOLATION
Gerhardt Blain, owner of Blain's Mobile Home Court of Billings, Mont., was indicted on Dec. 16, 1998 in U.S. District Court for the District of Montana for allegedly violating the Clean Water Act. Blain allegedly installed a pipe that led from a septic system at his 200-unit mobile home park to a slough adjacent to the Yellowstone River. The slough is upstream from the drinking water intake of the City of Billings. It is estimated that the piping system discharged approximately 100 gallons of wastewater per minute into the slough at various times. Fecal coliform bacteria concentrations in samples from the pipe where extremely high. Exposure to water containing high levels of fecal coliform can cause a variety of diseases including skin and intestinal infections. The case was investigated by EPA Criminal Investigation Division and was prosecuted by the U.S. Department of Justice.
