Auto Body Shop Settles Wetlands Violation Complaint

EDGEWATER, Md. -- B&B Auto Body Shop of Edgewater, Md., has agreed to pay a $1,250 penalty for violating federal regulations by filling in protected wetlands near to Glebe Creek in Edgewater, Anne Arundel County, Md., adjacent to the body shop.

According to EPA’s July 1999 complaint, B&B Auto Body Shop did not obtain a required permit before filling an area of protected wetlands, which is part of a drainage swale on its property at 233 Mayo Road.

Under the Clean Water Act, a U.S. Army Corps of Engineers permit is required before dredged or fill material may be discharged into wetlands areas. The permit requirement is designed to minimize the destruction of wetlands, which serve a number of critical environmental and economic functions -- including flood control, water filtration, and wildlife habitat.

The company neither admitted nor denied the alleged violation. However, as part of the settlement, the company agreed to restore an area of wetlands greater than that involved in the alleged violation.
