FATHER AND SON CONVICTED OF ILLEGAL WASTE HANDLING
On April 15, Roy N. Hart, owner of the defunct North American Environmental Co. (NAE), a polychlorinated byphenyl (PCB) collection, storage and disposal facility in Clearfiled, Utah, pleaded guilty in U.S. District Court in Salt Lake City, Utah, to one felony count of violating the Resource Conservation and Recovery Act for the illegal disposal of hazardous waste. He faces a maximum sentence of five years imprisonment and/or a fine of up to $250,000. On the previous day, His son, John K. Hart, former operator of NAE, was sentenced in the same court to three years probation and 300 hours of community service. The sentence was a result of John Hart's guilty plea to two Toxic Substance and Control Act misdemeanor offenses, which involved the storage of PCBs without a permit and the storage of PCBs for a time period greater than one year. The younger Hart abandoned the NAE facility, leaving behind approximately one million pounds of PCBs. The use of PCBs is strictly regulated because they have been identified as a possible cause of cancer in people. The case was investigated by EPA's Criminal Investigation Division with assistance from EPA's National Enforcement Investigations Center.
