TWO CONVICTIONS IN CONNECTICUT HAZARDOUS WASTE CASE

James Hawley of New Haven, Conn., and Michael Knapp of Ashtabula, Ohio and Thomaston, Conn., were convicted in federal court on May 21 of conspiracy to violate the Resource Conservation and Recovery Act by illegally transporting and dumping hazardous wastes. They were employees of Cover-It Inc., portable shelter manufacturers in New Haven. Wastes containing toxic levels of lead and chromium are generated in the production of the shelter frames. Exposure to lead and chromium wastes can cause damage to the central nervous system and internal organs. The defendants were accused of removing and painting over the labelling of the waste drums in March 1997 and then dumping the drums near the New Haven Terminal shipping complex and near the Secondi Brothers Truck Stop in Milford, Conn. Hawley and Knapp each face a maximum sentence of 13 years imprisonment and/or fines of up to $750,000. Cover-It Inc. previously pleaded guilty and is awaiting sentence. The case was investigated by EPA’s Criminal Investigation Division and the Connecticut Department of Environmental Protection with the assistance of EPA’s National Enforcement Investigations Center.
