NEW HAMPSHIRE COMPANY WILL MAKE $2.3 MILLION PAYMENT
Kluber Lubrication North America L.P., of Londonderry, N.H., entered into a $2.3 million pretrial agreement with the U.S. Attorney for the District of New Hampshire in Concord on Dec. 21. Under the terms of the agreement, Kluber accepts responsibility for knowingly violating the Toxic Substances Control Act (TSCA) by importing grease products that were not listed on the Inventory of Chemical Substances maintained by EPA. The importation of unlisted products is not allowed by law in order to prevent the introduction of toxic materials into the environment. Kluber will pay a total of $2.3 million which will be divided as follows: $1.3 million will go to the United States, $750,000 will go to resolve an administrative action brought by EPA and $250,000 will fund a supplemental environmental project which Kluber will select at a future date, subject to the approval of the government. In addition, Kluber will be placed on supervision for 18 months and will present an educational program related to TSCA to an industry trade association. The case was investigated by EPA’s Criminal Investigation Division and the agreement was negotiated by the U.S. Attorney’s Office for the District of New Hampshire.
