Alaska Department of Transportation and Contractor Exclusive Landscaping Agree to Pay $11,100 for Storm Water Violations

The U.S. Environmental Protection Agency announced an agreement today with the Alaska Department of Transportation (ADOT) and Exclusive Landscaping and Paving (EL&P) to settle charges of violating storm water provisions of the federal Clean Water Act. The ADOT and ELP have paid an $11,100 penalty.

An EPA inspector visited the Fairbanks International Airport Drainage Improvement Project on August 6, 2004. Based on the inspection, the EPA alleged that, while the ADOT and ELP had obtained coverage under the Construction General Permit for storm water discharges, the two operators had failed to complete their storm water pollution prevention plan and to implement controls to prevent polluted runoff from entering the Tanana and Chena Rivers.

The Construction General Permit provides a quick application process to reduce delays in construction projects, while protecting water quality. The permit mandates certain precautions to minimize pollution, including developing and following a storm water pollution prevention plan and implementing best management practices.

“Any construction project can harm water quality, if you don’t have a clear plan to prevent it,” said Kimberly Ogle, EPA’s water quality enforcement manager. “The waters of Alaska are a precious resource and deserve the effort the law requires to keep them clean.”
