Memorandum discusses when, primarily because of significant public health, EPA will consider providing a bona fid prospective purchaser (BFPP) with a covenant not to sue following enactment of the 2002 Brownfields Amendments to the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly referred to as Superfund).
