Lead Renovation, Repair and Painting Rule - December 2014
In December 2014, the U.S. Environmental Protection Agency (EPA) announced 61 enforcement actions that require renovation contractors and training providers to protect people from harmful exposure to lead dust and debris, as required by EPA’s Lead-based Paint Renovation, Repair, and Painting (RRP) standards. The enforcement actions include 55 settlements and six complaints issued between February and October 2014 for renovations performed on pre-1978 homes and child-care facilities.
Region 1
CDL Commercial, LLC - Overview of Company and Facility Location
CDL Commercial, LLC (the Company) is located in Meriden, Connecticut. The settlement involves renovation projects conducted at properties located in New Haven, Essex and Meriden, Connecticut.
Violations
The Consent Agreement and Final Order (CAFO) settles alleged violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. In the CAFO, the United States alleges that the Company committed the following violations:
- Failure to Obtain Firm Certification from EPA.
- Failure to assign an EPA-certified renovator to the renovations.
- Failure to provide the owner of the units with the EPA approved pamphlet prior to each of the renovations.
- Failure to provide the adult occupant of the unit with the EPA approved pamphlet prior to one of the renovations.
- Failure to retain all records necessary to demonstrate compliance with the rule for a period of three (3) years following completion of the renovation activities.

East Coast Pros, LLC (the Company) is located in Norwalk, Connecticut. The settlement involves a renovation project conducted at a property located in Norwalk, Connecticut that contained a child-occupied facility. The property was constructed prior to 1978.
Violations

- Failure to Ensure Certification or Training.Failure to ensure that all individuals performing renovation activities on behalf of the firm are either certified renovators or are trained by a certified renovator.

The Complaint alleges violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. In the Complaint, the United States alleges that the Company committed the following violations:
- Failure to obtain initial certification from EPA.
- Failure to comply with work practice standards by using HEPA air filter exhaust on high speech machinery used to remove lead paint; failing to cover the ground with plastic sheeting or other disposable impermeable material as required; and failing to contain waste from renovation activities as required.
- Failure to provide written notification or post information signs notifying residents about renovation activities in the common area of the property.
- Failure to obtain a written acknowledgement that the owner received the EPA Renovate Right lead hazard information pamphlet, or obtain a certificate of mailing of the pamphlet, at least seven (7) days prior to the renovation.

- Failure to obtain certification. Failure to comply with work practice standards by failing to cover the floor, cover the ground, contain renovation wastes, and post signs as required by the rule. Failure to ensure workers are certified or trained by a certified renovator. Failure to assign certified renovators.

Violations
The Consent Agreement and Final Order (CAFO) settles alleged violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. In the CAFO, the United States alleges that the Company committed the following violations:
- Failure to Post Warning Signs. Failure to post signs warning occupants and other persons not involved in the renovation activities to remain outside the work area.
- Failure to Cover the Ground. Failure to cover the ground with plastic sheeting or other disposable impermeable material extending ten feet beyond the perimeter of surfaces undergoing renovation or a sufficient distance to collect falling paint debris.
- Failure to Erect Vertical Containment. Failure to take extra precautions in containing the work area to ensure that dust and paint chips from the renovation did not contaminate adjacent buildings or migrate to adjacent properties.
- Failure to Demonstrate Compliance with Renovator Requirement. Failure to provide documentation to demonstrate that a certified renovator provided on-the-job training to non-certified workers.

The Expedited Settlement Agreement (ESA) settles alleged violations of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. In the ESA, the United States alleges that the Company committed the following violations:
- Failure to Obtain Certification. Failure to obtain a firm certification from EPA before offering and performing renovations for compensation on property subject to the RRP Rule.
- Failure to Retain Records.Failure to retain records demonstrating compliance with the RRP Rule.
