EPA’s Pacific Southwest (Region 9) implements and enforces federal environmental laws in Arizona, California, Hawaii, Nevada, the Pacific Islands, and 148 Tribal Nations.

Title V of the Clean Air Act requires state and local permitting authorities to adopt an operating permit program for major sources of air pollution. These operating permits are often referred to as “Title V Permits".

Approved/Delegated Title V Permit Programs
In Region 9, all state and local permitting authorities have an approved operating permit program. The programs are adopted under 40 CFR part 70. For Pacific Islands, the programs are adopted under 40 CFR part 69.
Tribes may, but are not required to, adopt their own operating permit programs. EPA may also delegate its authority to a Tribe that meets the necessary requirements under Part 71. See Tribal agencies that have received a part 71 delegation of authority.

EPA Oversight of Title V Programs
Each approved or delegated operating permit program submits Title V permitting actions to the EPA for review. EPA may object to the issuance of a proposed Title V permit, or the public may petition the EPA to object to the Title V permit. Additionally, the EPA conducts Title V program evaluations to evaluate how approved or delegated Title V programs are being implemented.

For areas without an approved/delegated operating permit program, EPA is the Title V permitting authority and implements the program under 40 CFR part 71.
